These Terms & Conditions apply to the use of the APN Garden Rooms website and to products and services supplied by APN Garden Rooms.

By using our website, purchasing a product, placing an order or instructing us to provide a service, you agree to these Terms & Conditions.

1. About APN Garden Rooms
APN Garden Rooms provides garden room designs, design and technical plan packs, architectural and technical services, planning support, Building Regulations services, on site surveys and related products and services.
​
Some products and services may be supplied directly by APN Home Limited while others may be supplied by independent third party manufacturers, contractors, consultants or service providers.
​
Where a third party is responsible for supplying a particular product or service, this will normally be made clear during the purchasing or instruction process.
​
2. Garden Room Designs and Plan Packs
Our garden room designs and plan packs are intended to provide homeowners with professional design and technical information from which a garden room can be planned and constructed.
​
Unless expressly stated otherwise, purchasing a garden room plan pack does not include:
• A site survey
• Site specific structural design
• Structural calculations
• Ground investigation
• Planning permission
• Building Regulations approval
• Party Wall advice or services
• Drainage investigation
• Utility searches
• Construction or installation
• Materials or building products unless specifically included in the order

Standard designs are not prepared specifically for an individual property unless our adaptation or bespoke design service has also been instructed.

3. Site Suitability
Every property and garden is different.
​
It is the homeowner's responsibility to ensure that the proposed garden room is suitable for the intended site.
​
Local factors may affect the design, including:
• Ground conditions
• Levels and slopes
• Existing buildings
• Trees and vegetation
• Drainage
• Underground services
• Access
• Boundaries
• Easements and covenants
• Planning restrictions
• Building Regulations requirements

Where there is any uncertainty, we recommend an on site survey or other appropriate professional investigation before construction begins.
​
​
4. Dimensions and Measurements
Dimensions shown on standard garden room designs are based upon the published design and should not be assumed to confirm suitability for a particular property.
​
The homeowner or their contractor should verify all relevant site dimensions before ordering materials or commencing construction.
​
APN Garden Rooms cannot accept responsibility for construction based on measurements which have not been checked on site.
​
​
5. Adapt Your Design
Where our Adapt Your Design service is purchased, we will amend the selected garden room design in accordance with the agreed brief.
​
The service will be limited to the scope confirmed when the order is placed.
​
Changes outside the agreed scope may result in an additional fee.
​
Alterations requested after drawings or documents have been substantially completed may also be subject to an additional charge.
​
​
6. Bespoke Architectural and Technical Services
Where we provide a bespoke architectural, planning or technical service, the precise scope of work will be confirmed separately.
​
Our services will be performed with reasonable care and skill as required by applicable consumer law.
Any estimated timescale is given in good faith but may be affected by circumstances outside our reasonable control, including information awaited from clients, consultants, local authorities, Building Control bodies and other third parties.
​

7. On Site Surveys
An on site garden room survey is intended to provide general professional advice about the proposed project and its location.
​
Unless expressly included in our quotation, an on site survey does not include:
• Trial holes
• Soil testing
• Drain surveys
• Opening up works
• Structural calculations
• Asbestos surveys
• Underground utility detection
• Legal title investigations

We will normally rely upon visible conditions at the time of inspection and information supplied by the homeowner.
​
​
8. Planning Permission
Many garden rooms can potentially be constructed without a planning application, but this depends upon the property, the proposed building and the relevant planning circumstances.
​
We do not guarantee that a particular garden room will benefit from permitted development rights or receive planning permission unless we have specifically undertaken a planning assessment for that property.
​
Responsibility for confirming the planning position rests with the homeowner before construction begins.
​
Where APN Garden Rooms submits a planning application, the application fee payable to the relevant authority is separate from our professional fee unless expressly stated otherwise.
​
Planning decisions are made by the relevant planning authority and cannot be guaranteed by APN Garden Rooms.
​
​
9. Building Regulations
Whether Building Regulations approval is required will depend upon the size, construction, location and intended use of the garden room and other relevant circumstances.
​
Where Building Regulations drawings or services are purchased, these will be prepared within the agreed scope.
​
Approval remains the responsibility of the relevant Building Control body and cannot be guaranteed.
​
Any Building Control application fees, inspection fees, structural engineer's fees or other third party charges are separate unless expressly included in our quotation.
​
​
10. Structural Design
Standard plan packs may contain typical construction information but should not be interpreted as site specific structural engineering.
​
Where structural calculations or engineering design are required, these must be undertaken by an appropriately qualified structural professional.
​
Additional structural design may be required because of ground conditions, spans, loading, glazing, foundations or other site specific circumstances.
​
​
11. Construction
APN Garden Rooms does not undertake responsibility for the quality of construction carried out by a homeowner, builder or contractor unless APN Home Limited has expressly entered into a separate contract to undertake those works.
​
The builder remains responsible for:
• Checking dimensions
• Workmanship
• Construction methods
• Site safety
• Temporary works
• Sequencing
• Compliance with approved drawings and statutory requirements
​
Any departure from the drawings should be considered carefully and, where necessary, referred back to the designer, engineer or Building Control body.
​
​
12. Builders and Verified Partners
From time to time we may introduce homeowners to builders, installers, manufacturers, suppliers or other members of the APN network.
​
Unless we expressly state otherwise, those businesses operate independently of APN Home Limited.
​
Any construction or supply contract entered into between a homeowner and an independent business is a separate agreement between those parties.
​
Homeowners should satisfy themselves as to the suitability, price, availability, insurance and terms of any contractor or supplier before placing an order.
​

13. Products and the APN Garden Rooms Shop
Our website may offer building products, components, fixtures, finishes or accessories either directly or through third party suppliers.
​
Product descriptions, photographs and specifications are provided to help customers make purchasing decisions, but appearance may vary slightly due to manufacturing tolerances, natural materials, screen settings and product updates.
​
Where a product is supplied by a third party, additional supplier terms may apply.
​
Delivery dates given by suppliers are estimates unless expressly confirmed otherwise.
​
​
14. Prices
Prices shown on our website may be stated either including or excluding VAT.
​
Where VAT is applicable, this will be identified during the purchasing process.
​
We reserve the right to amend prices at any time, but this will not affect an order already accepted unless the customer agrees otherwise.
​
Any additional work requested outside the original scope will be quoted separately.
​
​
15. Payment
Payment terms will be stated when a product or service is ordered.
​
Digital plan packs and other online products will generally require payment in full before supply.
​
Professional services may require full payment or a deposit before work commences, depending upon the service purchased.
​
We are not required to commence work or release completed documents until payments due under the agreed terms have been received.
​
​
16. Digital Plan Packs, Immediate Access and Cancellation
APN Garden Room Plan Packs are digital products containing architectural designs, drawings, specifications, technical construction information and other downloadable material.
​
When purchasing a Plan Pack, you will be asked to confirm that you wish APN Garden Rooms to make the digital content available immediately.
​
Before completing your purchase, you must expressly agree that:
• You wish supply of the digital content to begin immediately
• You understand that your normal 14 day cancellation right will be lost once supply of the digital content begins
• You understand that once access to the Plan Pack has been provided, you cannot cancel the purchase simply because you have changed your mind
​
Once the Plan Pack has been made available for download or access, no change of mind refund will be provided, subject always to your statutory consumer rights.
​
This does not affect any legal rights you may have where digital content is faulty, materially different from its description or otherwise does not comply with applicable consumer law.
​
Your order confirmation will record your request for immediate supply and your acknowledgement that the statutory cancellation right is lost once supply begins.
​
​
17. Accessing or Using a Plan Pack
A customer must not obtain access to an APN Garden Room Plan Pack, download, copy or use the drawings and subsequently seek a refund on the basis that the design is no longer required or that they have changed their mind.
​
Once digital access has been provided following the customer's express consent, the purchase is treated as supplied for cancellation purposes, subject to statutory consumer rights.
​
Accessing, downloading or using the Plan Pack does not transfer ownership of the copyright or intellectual property contained within it.
​
The drawings remain the intellectual property of APN Home Limited and are supplied under the licence described in these Terms & Conditions.
​
There is one other thing I would do technically: don't pre tick the checkbox. Make them physically tick it before Wix/Shopify allows payment. The regulations require express consent; relying only on a sentence buried in the Terms is much weaker.
​
The government guidance specifically says the customer must agree to the instant download and confirm they understand they will lose the 14 day cancellation right.
​

18. Consumer Rights
Nothing in these Terms & Conditions is intended to restrict your statutory rights.
​
The Consumer Rights Act 2015 provides legal protections in relation to services and digital content, including requirements relating to reasonable care and skill and the quality and description of digital content.
​
Where these Terms conflict with rights which cannot legally be excluded, your statutory rights will take precedence.
​
​
19. Intellectual Property and Copyright
All garden room designs, drawings, plans, illustrations, photographs, technical details, written material, branding and other content produced by or for APN Garden Rooms remain protected by copyright and other intellectual property rights.
​
Purchasing a plan pack gives the purchaser a licence to use the supplied drawings and information for the construction of the garden room for their own project, subject to the licence supplied with the product.
​
Unless expressly agreed in writing, the purchaser may not:
• Resell the drawings
• Reproduce them commercially
• Publish or distribute them
• Upload them for public download
• Use them to create competing commercial products
• Remove APN ownership or copyright information
​
Builders may be provided with copies where reasonably necessary to construct the purchaser's project.
​
​
20. Website Information
We take reasonable care when preparing information for the APN Garden Rooms website.
​
However, general articles, guides and website content are provided for general information and should not be treated as project specific architectural, structural, planning or legal advice.
​
Professional advice should be obtained where the circumstances of a particular property require it.
​
​
21. Illustrations and CGI Images
Some garden room images displayed on the website are illustrations, artistic impressions, CGI images or design concepts.
​
They are intended to demonstrate the appearance and character of a design and may not represent every construction detail or material precisely.
​
The technical drawings and agreed specification should take precedence over promotional imagery where there is any difference.
​
​
22. Estimated Build Costs and Potential Savings
Any examples of construction costs or potential savings shown on the APN Garden Rooms website are indicative only.
​
Actual costs depend upon numerous factors including:
• Size
• Specification
• Location
• Ground conditions
• Access
• Labour rates
• Choice of materials
• Contractor pricing
​
References to potential savings, including savings compared with fully supplied garden room packages, are not guarantees that a particular percentage saving will be achieved.
​
Customers should obtain their own quotations before making financial commitments.
​
​
23. Liability
We do not seek to exclude or restrict liability where doing so would be unlawful.
​
Subject to that, APN Home Limited will not be responsible for losses arising from matters outside the agreed scope of our services or from construction carried out contrary to the drawings or professional advice provided.
​
We cannot accept responsibility for defects or losses arising from inaccurate information supplied to us by the customer or a third party.
​
We are also not responsible for the acts, omissions, workmanship or financial failure of independent contractors, suppliers or consultants introduced through the APN network.
​
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded.
​
​
24. Delays Beyond Our Control
We will not be responsible for delays caused by events outside our reasonable control.
​
These may include delays by:
• Planning authorities
• Building Control bodies
• Structural engineers
• Suppliers
• Contractors
• Delivery companies
• Utility companies
• Other third parties
​
Where reasonably possible, we will keep customers informed of significant delays affecting a service we are providing.
​
​
25. Complaints
If you are unhappy with a product or service supplied by APN Garden Rooms, please contact us in the first instance so that we have an opportunity to investigate the matter.

Nothing in these Terms is intended to prevent a consumer from exercising rights available to them under applicable law.
